TOS – Terms of Hosting Service
The following conditions regulate the supply and use of the Web Hosting service and related services.
Use of the services from Xlogic.org constitutes acceptance of these terms.
1) General Description of the Service
1.1 – Xlogic offers the customer the acceptance of a contract which allows them to use the requested services with the characteristics and performances defined by the chosen type, as reported in the technical data sheet of the service. The object of the contract is the rental of things or the license for use, for which the customer will never acquire ownership of the means made available.
1.2 – Xlogic will provide the customer with all the technical specifications and configuration data to be able to access the services offered . If, after the services have been configured, the customer makes changes that alter the original configuration, Xlogic cannot be held responsible for operational defects resulting from any incompatibilities with the IT systems that prevent or limit the customer’s ability to access to Xlogic services.
1.3 – Xlogic reserves the right to vary the technical characteristics of the services or the costs of the services at any time Hosting Plans. The changes may be integrative, to improve the functioning of the service, or restrictive, to restrict some functions. Each change will be published in the relevant service sheet and each customer will be notified before the aforementioned change.
2) Use of the Services and Customer Responsibilities
2.1 – The customer is fully responsible for the data entered in the space reserved for him and for any related disputes to the distribution of such data online. Declares, with this agreement, to exempt Xlogic from civil and/or criminal liability deriving from the management of data entered that violates the regulations in force.
2.2 – The customer is responsible for any copyright infringement caused by data or programs subject to rights copyright content contained in the server and not expressly provided by ‘account.
2.3 – Access to the Xlogic Services is permitted using reserved access keys (passwords).
The Customer is therefore required to keep the access keys with the utmost confidentiality and with the utmost diligence, undertaking not to reveal the keywords, user name or authentication code (user name and password) to unauthorized third parties and ensuring that they promptly inform Xlogic of any fact that makes such data known to third parties and of any unauthorized use of the same, assuming all responsibility for the consequences and/or damages caused through the use of the Services using the User Name and Password provided by Xlogic , pursuant to art. 2051 code civil Xlogic will have the right to suspend or modify the use of the User Name and Password in case of improper or unauthorized use of the same.
2.4 – The Customer undertakes a:
a) – Do not use the Services offered by Xlogic in an illicit or illegal manner and to ensure that any transmission or uploading information does not violate or transgress laws of the Italian State, regional, local or international.
b) – Do not use the services made available by Xlogic for the dissemination of material or extracts of material covered by copyright (by way of example but not limited to: music or multimedia files protected by copyright), except with the explicit written consent of the owner of such right and in any case reporting the source.
c) – Do not use or have third parties use the Xlogic services against morals and public order, in order to disturb the peacepublic or private, to cause offence, or direct or indirect damage to anyone, furthermore it is forbidden to insert in the web space dialers or materials or extracts of material that deal with pedophilia or racist, fanatical, pornographic, obscene, blasphemous, defamatory apologies .
d) – Do not carry out acts aimed at violating or attempting to violate the confidentiality of private messages , to damage the integrity of other people’s resources or to cause direct or indirect damage to anyone (for example but not limited to through pirated software, cracks, key generators, serials, viruses or other harmful components).
e) – Do not publish websites containing gambling, online casinos or in any case contents that do not comply with the provisions of law 401/1989 and subsequent amendments and additions, in the absence of the necessary authorizations required by current legislation.
f) – Do not spam or similar. To combat spam and prevent violations, Xlogic’s system automatically suspends accounts that send more than 250 emails per hour or large quantities of messages that are not delivered.
g) – Do not install scripts or software such as: TopSites, IRC Script/Bots on Xlogic servers , Proxy Scripts/Anonymizers, Pirate Software/warez, Image Hosting Scripts, AutoSurf, IP Scanners, Mail Bombers/Spam Scripts, Banner/Ad Services, Sports Events Broadcast Streaming of any nature, forums or websites distributing links to illegal content Warez /Pirate.
h) – To use the Cache in the CMS or Script installed on your site, in order to reduce server overload and speed up page opening.
3 – Use of Resources by the Customer
The customer cannot:
3.1 – Use more than 25% of system resources for more than 90 seconds, there are numerous activities that can cause such problems including: CGI Script, FTP, PHP, HTTP etc.
3.2 – Participate in any File Sharing or Peer to Peer activities.
3.3 – Run game servers like: Counter Strike, Battlefield 1942 etc.
3.4 – Run software that interfaces with an Internet Relay Chat (IRC Network).
3.5 – Run CronJobs with intervals less than 30 minutes.
4 – Domains and Available Domains
4.1 – Available domains: means the number of domains available that can be exploited in the hosting space purchased and not the registration or transfer of a domain name.
4.2– It is possible, during the registration phase, to purchase only the domain, the domain will be managed from Xlogic, the customer will then have to communicate the DNS (name server) parameters to be inserted in the domain panel.
5 – Responsibilities of the Backup service
Xlogic carries out a Weekly Backup of all web spaces with the exception of VPS (Virtual Private Servers) and Dedicated Servers, even if data restoration is not possible.
The Customer acknowledges and accepts:
a) that you are the only person who has access to your site’s security settings.
b) which constitutes its sole responsibility to carry out, at its own expense, the backup of all data from your Web Space.
c) R1soft and/or JetBackup are dedicated backup software that automatically perform daily backups of all data on an external hard disk. In the event of data loss, Xlogic SAS only guarantees the backup from the day before. R1soft and/or JetBackup are included in the Shared Hosting plan (Premium, Master, Business Plan while for the Eco, Mini, Lite and Base Plans they are optional and have a cost of €20.00 + VAT per year), in the plan WordPress Hosting, in the Reseller Hosting plan and in the Dedicated Hosting plan.
d) Given the above, the Customer exempts Xlogic from any liability in the event of total or partial loss of data, failure, malfunction, unauthorized access to the site or to the email address, for any reason.
6 – Suspension or Interruption of Service
6.1 – Xlogic reserves the right to interrupt the services, totally or partially, due to force greater or for reasons attributable to the user of the service at any time by sending the reason by e-mail to the email address provided by the customer at the time of subscription.
Xlogic undertakes to notify the customer, at least 10 days in advance of the expiry date of the contract, in the event that he is no longer able, or does not intend to renew this agreement at the end of its natural expiry.
6.2 – Xlogic has the right to suspend, without notice, the provision of the service if one of the following cases exists:
a) The customer becomes an active participant in attempts to violate Xlogic’s or third-party IT systems through the service made available by Xlogic itself.
b) The customer constitutes a situation of danger and/or instability of the system (by way of example but not limited to any abuse of resources made available or spam actions carried out towards third parties) following activities that cause damage to Xlogic.
c) The customer does not pay for the service purchased by the payment deadline .
d) The customer violates the paragraphs of the following contract: 2 – 2.1 – 2.2 – 2.3 – 2.4 or 3 – 3.1 – 3.2 – 3.3 – 3.4
e) The disk space of the hosting plan exceeds the assigned quota
Suspension or termination of services means the total impossibility – temporary or permanent – to use the services covered by this contract through any means of telecommunications. The ‘suspension’ or ‘termination’ of the service will result in the destruction of any material present in the services, which material will be removed from the servers owned by Xlogic after 10 days from the date of suspension and/or termination of the service. No request for compensation for damages can ever be made by the customer against the granting company following what is specified in the previous paragraphs.
7 – Xlogic Limitations of Liability
7.1– Xlogic will update its software to adapt it to the services, limited to its operating system and to the basic services mentioned when the releases are officially released. Interventions required to remedy anomalies directly attributable to the customer are not included in the obligations of this agreement.
7.2 – Any form of technical assistance to the customer on programming and/or management .
7.3 – Xlogic declines any responsibility either towards its customers or third parties for delays, poor functioning, suspension and/or interruption in the provision of services due to:
a) – Force majeure and/or unforeseeable circumstances.
b) – Malfunction or non-conformity of the connection devices the Customer has equipped with.
c) – Failures and malfunctions of machines and software, whether they are owned by the granting company of its suppliers.
d) – VPS and dedicated Servers, Managed Server means the configuration of the operating system, management server security, control panel installation, operating system updates, intervention in the event of downtime, further forms of technical assistance are excluded. VPS server unManaged, the configuration and total management will be the responsibility of the customer.
In such cases the Customer acknowledges and accepts that he will have nothing to claimto Xlogic as compensation.
The Customer must notify Xlogic immediately or no later than 24 calendar hours of any irregularities in the service.
Any damage caused by careless communication will be considered the responsibility of the Customer.
8 – Price and Payment Terms
8.1 – The payment of the fee must be made at the time of activation of the service for the first period , while for subsequent periods the payment of the fee must be made within 2 days of the deadline, under penalty of deactivation of the services linked to the hosting plan .
8.2 – Any expenses with different methods or for abroad are the responsibility of the user, the Banking costs for bank transfers are totally borne by the payer. For non-European countries, only payment via Paypal or Credit Card is permitted.
8.3 – Automatic renewal on credit card: Automatic renewal is activated if the first payment has been made by credit card; on the day the service expires, the system will attempt to automatically capture the payment from the credit card without explicit consent. It is possible to deactivate automatic renewal at any time from your Customer Area (guide on how to deactivate automatic renewal)
8.4 – Xlogic grants the Customer a Money Back Guarantee valid for 7 days from activation of the service of subscribed hosting. After 7 days from the activation of the subscribed hosting service, the Customer loses the right to request a refund from Xlogic of the price paid for subscribing to the service. Domains are not refundable, as they are the property of the Customer. Renewals and service addons or upgrades are not refundable. In the case of WordPress Hosting or where the transfer of the site (Files/Database/eMails) is included, the cost relating to the transfer will be deducted from the total refund.
9 – Duration of the contract
This agreement has a duration of 12 months from acceptance for the Eco, Mini, Lite, Base, Premium, Master and Business Hosting Service
For Promotions active on Hosting Plans, the validity is 12 months from acceptance of the service.
10 – Tax Charges
Any tax burden deriving from the execution of the contract, including any taxes for advertising activities, are borne by the User.
11 – Denial of service
Xlogic reserves the right not to provide services to anyone, at any time and for any reason.
12 – Termination Clause
Xlogic reserves the right to declare the contract terminated pursuant to and for the purposes of Article 1456 of the Civil Code. in cases of failure to fulfill the obligations contained in the previous points.
13 – Complaint procedures and competent court
13.1– Any complaints regarding any aspect relating to the contractual relationship and/or the provision of the service must be forwarded to Xlogic, via eMail or Fax within 7 (seven) days from the occurrence of the reason. Xlogic will examine the complaint and provide a response to the customer within 4 (four) days of receiving it.
13.2 – The supply relationship is governed by the laws of the Italian State. For all disputes relating to this agreement, the parties recognize the exclusive and subsidiary jurisdiction of the Court of Turin.
13.3 – This agreement will be registered only in case of use.
14 – Contract Properties
This contract belongs to Xlogic, even partial use in any relationship unrelated to it is prohibited.
This contract is made up of 14 (FOURTEEN) articles.
This contract, MANDATORY ACCEPTED ONLINE AT THE TIME OF THE ORDER, involves the full and unconditional acceptance of the clauses contained including the information pursuant to EU Regulation 679 / 2016 or GDPR (processing of personal data indicated as PRIVACY in the links)
Privacy – Processing of personal data
Information pursuant to EU Regulation 679 / 2016 or GDPR (from 05/25/2018) containing provisions regarding the protection of personal data .
Xlogic SAS offers web space rental services and is actively committed to safeguarding the personal data of its customers and anyone who entrusts this data to our processing. Xlogic SAS customers will be able to deposit data, including texts, databases, images and other documents of their property in the web space offered by us. Xlogic SAS will not process the data that the customer enters into its web space.
We recommend our customers to carefully read this information before subscribing to one of our services.
Data controller
With the request to activate the service, the registered Customer, as data controller (hereinafter Customer or Owner) of personal data carried out via your website
NOMINATION
Xlogic SAS as DATA PROCESSOR with reference to the treatments carried out by him, based on the articles. 4 and 28 of the European Regulation 679/2016 and the regulations regarding the protection of personal data. For everything that is not regulated by this agreement, reference must be made to the rules indicated above.
Object of processing
Xlogic SAS as Data Controller processes data on behalf of and based on the instructions of the customer as Data Controller; The activities carried out by Xlogic SAS on behalf of the Customer or Owner are the following: Web Hosting, Data Storage and Mail Server.
Types of Data collected
Among the Personal Data collected by Xlogic SAS, independently or through third parties, there are: name and surname, email address, demographic data, website, IP address, browser type , time and duration of the visit, country of origin, web page of origin and exit, ISP, cookies and usage data. Complete details on each type of data collected are provided in the dedicated sections of this privacy policy or through specific information texts displayed before the data are collected.
Personal Data may be freely provided by the User or, in the case of Usage Data, collected automatically when using Xlogic SAS.
Unless otherwise specified, all Data requested by Xlogic SAS is mandatory. If the User refuses to communicate them, it may be impossible for Xlogic SAS to provide the Service. In cases where Xlogic SAS indicates some Data as optional, Users are free to refrain from communicating such Data, without this having any consequence on the availability of the Service or its operation.
Users who have doubts about which Data is mandatory can contact Xlogic SAS at any time.
Any use of Cookies – or other tracking tools – by Xlogic SAS or the owners of third-party services used by Xlogic SAS, unless otherwise specified, has the purpose of providing the Service requested by the User, in addition to further purposes described in this document and in the Cookie Policy.
The User assumes responsibility for the Personal Data of third parties obtained, published or shared through Xlogic SAS and guarantees that he or she has the right to communicate or disseminate them, freeing Xlogic SAS from any liability towards third parties.
Method and place of processing of the collected data
Treatment methods
Xlogic SAS does not sell or exchange users’ personal data with third parties for Marketing purposes but adopts appropriate security measures aimed at preventing access, disclosure, modification or destruction of the Data Personal.
The processing is carried out using IT and/or telematic tools, with organizational methods and logic strictly related to the purposes indicated.
Technical-organisational and security measureszza
Xlogic SAS adopts all security measures required by law or otherwise deemed suitable in order to minimize the risk of destruction, loss of data, unauthorized access or in any case relating to unauthorized processing of the data.
Xlogic SAS periodically checks the adequacy of the security measures adopted, also evaluating any changes thereto based on technological progress, which will be documented on the website.
Xlogic SAS undertakes to communicate any cases of unauthorized or unauthorized access to the Customer or Owner within the established deadline of 72 hours.
The security of data processing is guaranteed by the control of access to the information system, by the control of access authorizations and by control operations:
– Servers monitored H/24
– Hard disk duplications (raid systems)
– Daily data backup
– SSL encryption of web interfaces, email, data
– Geographic redundancy of name servers
– Dedicated servers for the various services
Obligations borne by the Customer / Owner
The Customer or Owner undertakes to inform its customers or users, as well as interested parties on the data processed, on the methods and purposes of the processing, on the consequences of consent through specific information drawn up in accordance with current laws .
The Data will be processed by Xlogic SAS with automated means which do not involve actual knowledge of the activity or information described in the information processed; The exemptions referred to in Directive 2000 / 31 / EC and in Legislative Decree 70 / 2003 therefore apply.
The Customer or Owner undertakes to indemnify Xlogic SAS from any legal requests relating to the non-compliance of the Information or from any legal actions resulting from the commission of offenses by customers or users of the Customer / Owner .
Confidentiality
The data processors, Xlogic SAS as responsible and all the subjects who have the possibility of accessing the customer’s personal data are bound by an obligation of Confidentiality and are instructed regarding the particular obligations relating to Protection of the Data.
In addition to Xlogic SAS, in some cases, other subjects involved in the organization of Xlogic SAS (administrative, commercial, marketing, legal, system administrators) or external subjects (such as third-party technical service providers, hosting providers, IT companies, communication agencies) also appointed, if necessary, as Data Processors by Xlogic SAS. The updated list of Managers can always be requested from the Data Controller.
Personal data will always be processed within the European Community, with the exception of the data necessary for the registration of gTLD and ccTLD domains, SSL certificates which by the very nature of the service are also managed outside the European Community .
Legal basis of processing
Xlogic SAS processes Personal Data relating to the User if one of the following conditions exists:
1) the User has given consent for one or more specific purposes; Note: in some jurisdictions Xlogic SAS may be authorized to process Personal Data without the User’s consent or another of the legal bases specified below, until the User objects (“opt-out”) to this treatment. However, this is not applicable if the processing of Personal Data is regulated by European legislation on the protection of Personal Data;

4) processing is necessary for the performance of a task in the public interest or for the exercise of public powers vested in Xlogic SAS;
5) the processing is necessary for the pursuit of the legitimate interest of Xlogic SAS or third parties.
EHowever, it is always possible to ask Xlogic SAS to clarify the concrete legal basis of each processing and in particular to specify whether the processing is based on the law, provided for by a contract or necessary to conclude a contract.
Place
The data is processed at the Xlogic SAS headquarters and at the data centers located in England, Germany and the Netherlands. Both the headquarters and the data centers are located in the European Union. For further information, contact Xlogic SAS.
The User’s Personal Data may be transferred to a country other than the one in which the User is located. To obtain further information on the place of processing, the User can refer to the section relating to the details on the processing of Personal Data.
The User has the right to obtain information regarding the legal basis for the transfer of Data outside the European Union or to an international organization governed by public international law or constituted by two or more countries, such as the UN, as well as regarding the security measures adopted by Xlogic SAS to protect the Data.
If one of the transfers just described takes place, the User can refer to the respective sections of this document or request information from Xlogic SAS.
Retention period
The Data is processed and stored for the time required by the purposes for which it was collected.
a) Personal Data collected for purposes related to the execution of a contract between Xlogic SAS and l The User will be retained until the execution of this contract is completed.
b) Personal Data collected for purposes attributable to the legitimate interest of Xlogic SAS will be retained until such interest is satisfied. The User can obtain further information regarding the legitimate interest pursued by Xlogic SAS in the relevant sections of this document or by contacting Xlogic SAS.
c) When the processing is based on the User’s consent, Xlogic SAS may retain the Personal Data for longer until such consent is not revoked. Furthermore, Xlogic SAS may be obliged to retain Personal Data for a longer period in compliance with a legal obligation or by order of an authority.
At the end of the retention period, the Personal Data will be deleted. Therefore, upon expiry of this term, the right of access, cancellation, rectification and the right to data portability can no longer be exercised.

The User’s Data is collected to allow Xlogic SAS to provide its Services, as well as for the following purposes: Registration and authentication, Contacting the user, Statistics, SPAM Protection, Access to accounts on third-party services, content commenting, payment management, interaction with Live Chat platforms and interaction with social networks and external platforms.

Personal Data is collected for the following purposes through the use of these services:
Access to accounts on third-party services
This type of service allows Xlogic SAS to collect Data from your accounts on third-party services and perform actions with them.
These services are not activated automatically, but require the express authorization of the User.
Login to your Twitter account (Twitter, Inc.)
This service allows Xlogic SAS to connect with the User’s account on the Twitter social network, provided by Twitter, Inc.

Content comment
The commenting services allow Users to formulate and make public their comments regarding the content of Xlogic SAS.
Users, depending on the settings decided by Xlogic SAS, can also leave comments anonymously. The email address entered by the User may be used to send notifications of comments regarding the same content.
Users are responsible for the content of their comments. In the event that a comment service provided by third parties is installed, it is possible that, even if Users do not use the comment service, it collects traffic data relating to the pages in which the comment service is installed. .

Payment management
Payment management services allow Xlogic SAS to process payments via credit card, bank transfer or other instruments. The data used for payment are acquired directly by the manager of the requested payment service without being processed in any way by Xlogic SAS.
Some of these services may also allow the scheduled sending of messages to the User, such as emails containing invoices or payment notifications.
PayPal (Paypal Inc.)
PayPal is a payment service provided by PayPal Inc., which allows the User to make online payments.

If an interaction service with Live Chat platforms is installed, it is possible that, even if Users do not use the service, it collects Usage Data relating to the pages in which is installed. Furthermore, Live Chat conversations will be recorded and can be saved both by Xlogic SAS and by the User.

The Tawk.to Widget is an interaction service with the Tawk.to Live Chat platform, provided by tawk.to ltd.

This type of service allows you to interact with Social Networks, or with other external platforms, directly from the xlogic.org pages.

If an interaction service with Social Networks is installed, it is possible that, even if Users do not use the service, it collects traffic data relating to the pages on which it is installed.

The LinkedIn button and widgets are interaction services with the Linkedin Social Network, provided by LinkedIn Corporation.

Google Analytics is a web analytics service provided by Google Inc. (“Google”). Google uses the Personal Data collected for the purpose of tracking and examining the use of xlogic.org, compiling reports and sharing them with other services developed by Google.
Google may use Personal Data to contextualize and personalize the ads of its advertising network.

User Rights
Users can exercise certain rights with reference to the Data processed by Xlogic SAS, in particular:

All Professional Hosting, Reseller Hosting, Dedicated Server and VPS (Virtual Private Server) plans are guaranteed by an SLA set at 99.9% on a monthly basis. The SLA for uptime covers the operation of the entire network infrastructure, the time of unavailability of the service will be considered as downtime.
The downtime period is calculated from the moment the customer reports it (via ticket or e-mail) until the moment the service becomes available again. The following cases are not covered by the SLA:
1 – Downtimes that occur due to natural disasters or DDoS attacks against the network they do not count towards the SLA calculation.
2 – Service interruptions caused by malfunctions of the connection backbones or problems relating to malfunctions of the your line.
3 – Malfunction and/or incorrect configurations of any software installed by the customer.
4 – Pre-advised data center maintenance or maintenance and upgrades of our Servers.
